EB-1A Extraordinary Ability, Step by Step

The top employment green card for people with extraordinary ability — the criteria, the evidence, and self-petitioning without an employer.

What EB-1A is

EB-1A is the first-preference employment green card for people with extraordinary ability in sciences, arts, education, business, or athletics, shown by sustained national or international acclaim.

No job offer and no labor certification are required, and you may self-petition. It is the fastest employment route for those who qualify — but the bar is high.

The criteria: meet three of ten

USCIS lists ten evidence criteria. You must meet at least three (or show a one-time major award, such as a Nobel Prize or Olympic medal). The best-known criteria:

Two-step review

Meeting three criteria is only step one. USCIS then makes a final merits decision: does the whole record show you are among the small percentage at the very top of your field?

Cases fail at step two when the evidence is thin — for example, judging done once, or press that is really a paid placement. Depth and independence of evidence matter more than counting criteria.

Process and timing

You file Form I-140 with the evidence package. Premium processing is available at 15 business days. After approval, you wait for your priority date if your category and country are not current, then adjust status or process at a consulate.

EB-1 is current for most of the world in most months, which is why it is so valuable — but India and China have their own EB-1 lines with waits.

EB-1A vs NIW

EB-1A demands a higher level of acclaim but no showing of national importance and no job offer. NIW demands national importance but a lower level of personal acclaim. Many strong researchers qualify for NIW before they qualify for EB-1A, and some file both.
