EB-2 National Interest Waiver (NIW), Step by Step

The EB-2 green card without a job offer or labor certification — who qualifies, what evidence matters, and where the wait sits.

What NIW is

The National Interest Waiver is an EB-2 green card for people whose work has substantial merit and national importance. Unlike regular EB-2, it needs no job offer and no labor certification (PERM). You can self-petition.

It is popular with researchers, founders, engineers, and physicians because the case rests on your work, not on an employer.

The three-part test (Matter of Dhanasar)

USCIS judges NIW cases on three prongs: your proposed endeavor has substantial merit and national importance; you are well positioned to advance it; and on balance, waiving the job offer and labor certification benefits the United States.

Evidence that carries weight

Strong cases document impact, not just activity: citations to your work, adopted research, products in use, press coverage, judging others' work, and letters from independent experts who explain why the work matters.

Weak cases list duties and diplomas without showing influence. NIW is granted on the record you build, so evidence quality decides most cases.

Process and timing

You file Form I-140 with the NIW evidence. Premium processing is available for NIW petitions at 45 business days. Approval of the I-140 does not by itself give a green card.

After approval you wait for your priority date to become current in EB-2 for your country of birth, then file for adjustment of status (I-485) or go through consular processing. For applicants born in India or China, that wait is currently the longest part.

Common mistakes

Filing before the record is ready is the most common one: a denied NIW costs the filing fee and the time, and a second filing starts over. Many applicants spend a year building citations, publications, or a track record first.

Another is confusing NIW with EB-1A: NIW has a lower bar than extraordinary ability, but it still demands documented national importance, not just a good career.
